Terms of Service LoveLane App
Please read these terms carefully before accessing or using our services.
Your access and use of the services constitute your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreement or arrangement with you. LoveLane may immediately terminate these Terms or any services with respect to you, or generally, cease offering or deny access to the services or any portion thereof, at any time for any reason.
LoveLane may amend the Terms related to the services from time to time. Amendments will be effective upon LoveLane’s posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable services. Your continued access or use of the services after such posting constitutes your consent to be bound by the Terms, as amended.
In addition, when using certain services, you shall be subjected to any additional terms applicable to such services that may be posted on the Service from time to time, including, without limitation, the Privacy Policy. All such terms are hereby incorporated by reference into these Terms of Service.
The Service
Services Description:
The Service constitutes a technology platform that enables consumers to access information, activities, and experiences regarding local destinations/activities and a platform for users to easily provide consumers with such information.
User Account:
In order to use most aspects of the Services, you must register for and maintain an active personal user Services Account (“Account”). You are required to register with LoveLane in order to access and use certain features of the Service. If you are accessing the Services through a third-party site or service, LoveLane may require that your user information be the same as your user information for such third-party site or service. If you choose to register for the Service, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Service’s registration form. Failure to do so shall constitute a breach of this Terms of Services, which may result in immediate termination of your account. You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account. Account registration requires you to submit to LoveLane certain personal information, such as your name, address, mobile phone number, and age. You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the Services. LoveLane reserves the right to refuse registration of or cancel a LoveLane account at its discretion. Unless otherwise permitted by LoveLane in writing, you may only possess one Account.
Modification to Service:
LoveLane reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without noticing. You agree that LoveLane shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
Conditions of Use
User Conduct:
You are solely responsible for all information, text, software, music, sound, photographs, graphics, video, messages, customers’ safety, or other materials (“content”) that you upload, post, publish or display (hereinafter, “post”) or otherwise transmit or use via the Service, whether as an end user or otherwise. The following are examples of the kind of content and/or use that is illegal or prohibited by LoveLane. LoveLane reserves the right to investigate and take appropriate legal action against anyone who, in LoveLane’s sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators, and reporting you to the law enforcement authorities. You agree to not use the Service to:
- Post or otherwise transmit any content that (i) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful racially, ethnically or otherwise objectionable; (ii) you do not have a right to transmit under any law or under contractual or fiduciary relationships; (iii) pose or create a privacy or security risk to any person; (iv) infringe any intellectual property or other proprietary rights of any party; (v) constitute unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation; (vi) contain software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or (vii) in the sole judgment of LoveLane, is objectionable or which restricts or inhibits any other person from using or enjoying the Service, or which may expose LoveLane solely or its users to any harm or liability of any type;
- impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- solicit personal information from anyone under the age of 18;
- harvest or collect email addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
- advertise or offer to sell or buy any goods or services for any business purpose that is not specifically authorized;
- interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service; or
- violate any applicable local, state, national or international law, or any regulations having the force of law;
- further or promote any criminal activity or enterprise or provide instructional information about illegal activities; or
- Obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Service.
User Fee Terms:
When you purchase an offer from any members in LoveLane, you are purchasing the services directly from the owner, not LoveLane. We will only help our sellers to verify your payment information. In addition to the fees you pay for the offers, you acknowledge that LoveLane reserves the right to charge for any portion of the Service (“Service Fees”) and to change its Service Fees from time to time at its discretion. You agree to pay all fees when due in accordance with the terms set forth on the Site and these Terms of Service. If you are required to provide LoveLane information regarding your credit card or other payment instruments, you represent and warrant that such information is true and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your profile or credit card expiration date) that may occur. If you dispute any charges you must let LoveLane know within three (03) days after the date that you carry out the offer purchased. If LoveLane terminates your account and use of the Service because you have breached these Terms of Service, you shall not be entitled to the refund of any unused portion of fees or payments (if any). Service Fees are also non-refundable.
Restriction
You may not: (i) remove any copyright, trademark, or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by LoveLane; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.
Third-Party Websites
The Service may provide, or third parties may provide, links or other access to other sites and resources on the Internet. LoveLane has no control over such sites and resources and LoveLane is not responsible for and does not endorse such sites and resources. You further acknowledge and agree that LoveLane shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any Offers, content, events, goods, or services available on or through any such sites or resources. Any dealings you have with third parties (including LoveLane Creators) found while using the Service are between you and the third party, and you agree that LoveLane is not liable for any loss or claim that you may have against any such third party.
Limitation of Liability
LoveLane’s responsibility is limited to facilitating the availability of our website, application, and services. Participation in any of the events offered by travel buddies is at your own risk. LoveLane’s liability for damages shall be limited to the amount paid to us by you as a traveler. Except as provided herein, in no event shall we be liable for any indirect, special, incidental, or consequential damages of any kind, whether in an action of contract, negligence, or other tortuous actions resulting from or arising out of participation in any of the events offered by travel buddies.
Warranty Disclaimers
Your use of the service is at your sole risk. The service is provided on an “as is” and “as available” basis. LoveLane does not warrant that our website and/or our services will be uninterrupted or error-free. We may correct, modify, amend, enhance, improve and make any other changes to our website and our services at any time or discontinue displaying or providing any content or features without notice to you, being a website visitor or a user.
User Disputes
You agree that you are solely responsible for your interactions with any other users in connection with the Service and LoveLane will have no liability or responsibility with respect thereto. LoveLane reserves the right but has no obligation, to become involved in any way with disputes between you and any other users of the Service.
In case of a complaint about, or issue with the platform, app, or services, please contact LoveLane at hello@lovelane.co to resolve the problem. As a user, you agree that in case of a no-show or dissatisfactory deviation in the offer created by you, the traveler will be refunded and you won’t receive payment. As a traveler, you understand that in case of a no-show or no completion of/interruptions during the offer caused by you, you as a traveler are responsible for any damages up to the amount paid.
In case of any damage claims or other complaints related to the event exceeding the amount paid, LoveLane will mediate in finding a reasonable solution between users. LoveLane reserves the right but has no obligation, to become involved in any way with disputes between you and any other users of Service.
Miscellaneous
The failure of either party to exercise, in any respect, any right provided for herein shall not be deemed a waiver of any further rights hereunder. LoveLane shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond LoveLane’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including “line-noise” interference). If any provision of this Terms of Services is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Terms of Services shall otherwise remain in full force and effect and enforceable. This Terms of Services is not assignable, transferable, or sub-licensable by you except with LoveLane’s prior written consent. LoveLane may transfer, assign or delegate this Terms of Services and its rights and obligations without consent. Both parties agree that this Terms of Services is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications, and other understandings relating to the subject matter of this Terms of Services and that all modifications must be in a writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of these Terms of Services and you do not have any authority of any kind to bind LoveLane in any respect whatsoever. Headings for each section have been included above for your convenience, but such headings do not have any legal meaning, and may not accurately reflect the content of the provisions they precede.
